
Obtain Lawful Permanent Residence
The primary benefit of the EB-5 Investor Program is obtaining lawful permanent residence (a Green Card) for the investor and qualifying family members. Permanent residence allows families to live, work, and study anywhere in the United States while enjoying many of the same rights and opportunities available to other permanent residents.
Lower College Tuition
One of the most significant advantages involves education.
Many of our EB-5 clients have children studying in the United States under international student programs. International tuition can easily exceed $40,000 to $50,000 per year, and in many cases costs considerably more.
Once the family obtains permanent residence, eligible students may qualify for resident tuition rates instead of international tuition rates, potentially saving tens of thousands of dollars each year. For families with multiple children, those savings can be even greater.
For parents already investing heavily in their children's education, the EB-5 Program can become an important long-term financial strategy in addition to an immigration solution.
Freedom to Work Anywhere
Another important benefit is employment flexibility.
Unlike many temporary employment visas, permanent residents are not restricted to working for a single employer or business.
For example:
- H-1B workers generally must remain employed by their sponsoring employer.
- E-2 Treaty Investors typically work only within their investment enterprise.
Once EB-5 investors become lawful permanent residents, they may work for virtually any employer, start a business, change careers, or retire without immigration-related employment restrictions.
In addition, many applicants who file an Adjustment of Status application may qualify for employment authorization while their EB-5 petition is pending, allowing them to begin working before receiving their Green Card.
Include Your Immediate Family Under One Investment
Another major advantage of the EB-5 Program is that one qualifying investment may provide immigration benefits for an entire immediate family.
Under current U.S. immigration law, a single qualifying investment may generally include:
- The principal investor
- The investor's spouse
- Unmarried children under 21 years of age
There is, however, an important rule that families should understand. Children who are 21 years of age or older are considered adults under U.S. immigration law and are no longer eligible to immigrate as derivative beneficiaries under their parents' EB-5 petition. In those situations, each qualifying family unit would generally need to make its own separate EB-5 investment to obtain immigration benefits.
This is one reason why timing is often critical when planning an EB-5 investment.
