What to do if Your Case is Denied

 

 

Orlando Immigration Attorney Nayef Mubarak talks about what to do if your case is denied. What are your options and what can be done, if anything? First, if you were in removal proceedings and the immigration judge denied your form of relief, you now have an order of removal, better known as a deportation order. You will be filing an order to appeal with the Board of Immigration Appeals and you have 30 days to do so. Make sure you speak to your attorney to see if your appeal is the best move for you. If your case was denied by USCIS, many forms don’t allow to appeal, but if they do you would be filing with the administrative appeals office, what we call the AAO. Finally, sometimes filing an appeal might not be in the best interest for you. In some cases, we simply refile the case. You must look forward to what’s going to be the best option and best form of relief quickly as in most cases you only have 30 days to do so.
